Terms of Service

1. Acceptance of Terms

By accessing or using the website located at bettorlytics.com (the “Service”), operated by Bettorlytics LLC (“Bettorlytics,” “we,” “us,” or “our”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you must not access or use the Service.

2. Description of Service

Bettorlytics is a sports betting analytics platform that provides real-time market data streaming from prediction markets (including Kalshi and Polymarket) and traditional sportsbooks (including DraftKings, FanDuel, BetMGM, Caesars, and BetRivers), automated edge and arbitrage detection, and AI-powered predictive analytics for NFL, NBA, and MLB games. The Service is an informational and analytical tool—we do not accept, place, or facilitate bets or wagers of any kind.

3. Account Registration

To access certain features of the Service, you must create an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain the security and confidentiality of your login credentials
  • Accept responsibility for all activity that occurs under your account
  • Notify us immediately of any unauthorized use of your account

You must be at least eighteen (18) years of age, or twenty-one (21) in jurisdictions that require it for sports betting-related activities, to create an account and use the Service.

4. Subscription Tiers & Billing

4.1 Free Tier

The Free tier provides access to market data, game schedules, and basic dashboard features at no cost.

4.2 Pro Tier

The Pro tier provides access to AI predictions, per-market edge calculations, alerts, and advanced analytics for a recurring subscription fee. Pricing is displayed on our website and is subject to change with reasonable notice.

4.3 Billing

Subscriptions are billed through Stripe on a recurring basis (monthly or annually, depending on the plan selected). By subscribing, you authorize us to charge your payment method at the beginning of each billing cycle.

4.4 Cancellation & Refunds

You may cancel your Pro subscription at any time through your account settings. Upon cancellation, you will retain access to Pro features until the end of your current billing period. We do not provide prorated refunds for partial billing periods unless required by applicable law.

5. Acceptable Use

You agree not to:

  • Use automated tools, bots, scrapers, or crawlers to extract data from the Service
  • Redistribute, resell, or sublicense any market data, predictions, or analytics provided by the Service
  • Circumvent, disable, or interfere with tier restrictions, access controls, or security features
  • Use the Service to facilitate illegal gambling activities in any jurisdiction
  • Reverse-engineer, decompile, or disassemble any part of the Service
  • Transmit malicious code, viruses, or any material that could harm the Service or other users
  • Impersonate any person or entity or misrepresent your affiliation with any person or entity

6. Intellectual Property

All content, features, and functionality of the Service—including but not limited to text, graphics, logos, algorithms, predictive models, analytics, and software—are the exclusive property of Bettorlytics LLC or its licensors and are protected by copyright, trademark, trade secret, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works from any part of the Service without our prior written consent.

7. No Financial or Gambling Advice

The Service provides sports betting analytics and market data for informational purposes only. Nothing on the Service constitutes financial advice, gambling advice, investment advice, or a recommendation to place any bet or wager. AI predictions, edge detection results, and market comparisons are analytical outputs based on statistical models and should not be relied upon as a guarantee of any particular outcome. You are solely responsible for your own betting decisions and any financial consequences thereof.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY MARKET DATA, PREDICTIONS, OR ANALYTICS WILL BE ACCURATE, COMPLETE, OR TIMELY.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BETTORLYTICS LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE, ANY BETTING DECISIONS MADE USING INFORMATION FROM THE SERVICE, OR ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING UNDER THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

10. Market Data & Third-Party Information

Market data displayed on the Service is sourced from third-party platforms, including Kalshi, Polymarket, DraftKings, FanDuel, BetMGM, Caesars, and BetRivers. We do not guarantee the real-time accuracy, completeness, or availability of this data. Market prices may be delayed, and odds displayed on the Service may differ from those currently offered on the source platforms. Always verify odds directly on the relevant platform before placing any bet.

11. Indemnification

You agree to indemnify, defend, and hold harmless Bettorlytics LLC and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Service, violation of these Terms, or violation of any applicable law or regulation.

12. Termination

We reserve the right to suspend or terminate your account and access to the Service at our sole discretion, with or without notice, for conduct that we believe violates these Terms, is harmful to other users, or is otherwise objectionable. Upon termination, your right to use the Service ceases immediately. Provisions of these Terms that by their nature should survive termination (including, without limitation, intellectual property, disclaimers, limitation of liability, and indemnification) shall survive.

13. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any dispute arising from these Terms or your use of the Service shall be resolved exclusively in the state or federal courts located in Delaware, and you consent to the personal jurisdiction of such courts.

14. Changes to These Terms

We may revise these Terms at any time by posting the updated version on the Service. Material changes will be communicated through an updated “Last Updated” date and, where appropriate, by email or in-app notification. Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.

15. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.
